Terms of Use for Scribbo

1. Eligibility

Scribbo is intended for users aged 13 and older. By using the App, you represent that you meet this age requirement, or that you have a parent or guardian's permission to do so.

2. License to Use the App

Subject to your compliance with these Terms, we grant you a limited, non-exclusive, non-transferable, revocable license to download and use the App on a device you own or control, for your personal, non-commercial entertainment. All rights not expressly granted to you are reserved by Pengwings and its licensors.

3. User-Generated Content and Zero Tolerance for Abusive Content

Scribbo lets you submit content, including your nickname, avatar selection, chat messages, guesses, custom words, and drawings ("User Content"). You are solely responsible for the User Content you submit.

You agree that you will not submit User Content that:

• is defamatory, obscene, pornographic, abusive, harassing, or threatening;
• promotes discrimination, bigotry, racism, hatred, or violence against any individual or group;
• is illegal, infringes on any third party's rights, or violates any applicable law; or
• impersonates any person or entity, or is otherwise deceptive.

Pengwings has zero tolerance for objectionable content or abusive users of any kind.

To enforce this, the App applies automated profanity filtering to usernames and chat messages, and provides in-App tools for players to report a player or specific content, block a player, and vote to remove a disruptive player from an active room. We review reports of abusive User Content or abusive users and will take appropriate action, which may include removing content, suspending a player from a room, or banning a player from the App, without prior notice and at our sole discretion. If you encounter objectionable content or an abusive user, please use the in-App report feature or contact us at hello@pengwings.com.

By submitting User Content, you grant Pengwings a worldwide, royalty-free, non-exclusive license to host, store, transmit, and display that content solely as necessary to operate and provide the App's multiplayer functionality (for example, showing your drawing and guesses to other players in your room). We do not claim ownership of your User Content.

4. Acceptable Use

You agree not to:

• use the App for any unlawful purpose or in violation of these Terms;
• attempt to interfere with, disrupt, or gain unauthorized access to the App or other players' devices;
• use cheats, automation tools, bots, or exploits to gain an unfair advantage;
• reverse engineer, decompile, or disassemble the App, except as permitted by applicable law; or
• reproduce, redistribute, or sell any part of the App without our prior written consent.

5. Termination

We may suspend or terminate your access to the App, in whole or in part, at any time and without notice, if we believe you have violated these Terms, submitted or facilitated objectionable content, or engaged in abusive behavior toward other players. You may stop using the App at any time by uninstalling it from your device.

6. Advertising and Third-Party Services

The App may display advertisements and use third-party SDKs to operate multiplayer, avatars, and related functionality, as described in our Privacy Policy. We are not responsible for the content, policies, or practices of any third-party service used by or linked from the App.

7. Disclaimer of Warranties

The App is provided "as is" and "as available," without warranties of any kind, whether express or implied, including but not limited to implied warranties of merchantability, fitness for a particular purpose, and non-infringement. We do not warrant that the App will be uninterrupted, error-free, or free of harmful components, or that any User Content submitted by other players will meet your expectations.

8. Limitation of Liability

To the maximum extent permitted by applicable law, Pengwings shall not be liable for any indirect, incidental, special, consequential, or punitive damages, or any loss of data, arising from or related to your use of, or inability to use, the App, including any User Content submitted by other players.

9. Changes to These Terms

We may update these Terms from time to time. We will notify you of any changes by posting the updated Terms on this page and updating the "Last Updated" date above. Your continued use of the App after changes are posted constitutes acceptance of the revised Terms.
